The temporary employment contract

  • One of the most used work contracts in our country are Contingent Employment contracts. These contracts are used to correct situations and specific moments in which the company needs a greater amount of human resources to get ahead. 

    However, not all temporary contracts are produced by that, so it is necessary to know all types of temporary contracts that exist and the different characteristics they have.

    Characteristics of temporary contracts

    The temporary employment contracts establish contractual relationship between the company and the employee with a fixed term . These contracts usually have a start and end date, due to the fact that they are carried out with the objective of covering personnel needs by the company at specific times.

     

    The temporary contract can be full-time, or part-time if it is less than 40 hours per week. All the conditions of the temporary work and of the working day must be specified in a specific way, since any contract that does not say otherwise will be considered a full-time permanent contract.

    For temporary contracts to be legal it is necessary that the job they are going to fulfill is temporary, but they will be considered fraudulent temporary contracts. Temporary contracts of more than 24 months in a period of 30, or when two or more temporary contracts are made, will be considered indefinite contracts.

    Types of temporary contracts

    Although all temporary contracts have the same purpose and main characteristic, which is to limit their duration over time , there are different types. Each of them is made with a purpose and possesses

    Contract of work and service

    These works and service contracts are used in the execution of works or services, since although it is known that the need for the services of the worker will be temporary, the exact duration of the contract is unknown because it is uncertain .

    These contracts can not last more than 3 years , extendable to 4 according to the Collective Agreement by which they are governed. If they exceed this time they will have an indefinite contract in the company.

    Eventual contract due to production circumstances

    Temporary temporary contracts occur when people need to be hired due to market demands that cause an increase in production. They can also be made to solve the accumulation of tasks or excess orders that require a higher number of orders.

    These contracts are usually made for seasonal production increases or for the "season of a product". The maximum duration of these contracts is 6 months and if it is the first young job, the minimum duration will be 3 months.

    Interim contract

    This type of contract is made when a person is hired to replace a workerwho has left the company temporarily, but holds the reservation of his position until he rejoins.

    They are usually produced to cover the excesses of workers or to cover the hours of other workers that reduce their working hours.
